Juventus case: the EU Court of Justice and the “sports jurisdiction” question

With its ruling in the Juventus case, the Court of Justice of the European Union has returned to the long-standing issue of the so-called “sports jurisdiction” question — the relationship between sports justice bodies and State and EU courts. The decision redraws the boundaries within which sporting bodies’ decisions may escape review by ordinary judges.

For sports clubs — which are undertakings in every respect — and their executives, the issue touches governance, asset protection and litigation strategy: the ability to bring claims before State or EU courts, beyond internal sporting remedies, affects the management of the legal and reputational risks arising from disciplinary and sanctioning proceedings.
