Calculation of the limitation period for criminal offences

Describe anonymously what happened and when. The engine identifies the possible categories of offence under the Italian Criminal Code and the principal special criminal statutes, assesses concurrence and absorption, proposes for each of them the rule governing when time starts to run and calculates an initial limitation period. The result is indicative and does not replace reading the charge and the documents in the proceedings.

State the conduct, when it began and ended, whether it was repeated, how any profit was obtained and whether you know the article charged. Do not enter names, addresses or other personal data.

For a better result: give at least one complete date and state precisely whether the conduct occurred once only, was repeated or is still ongoing.

Assistant for completing your account

Answer a few questions. The answers will be added to the account and the calculation will be repeated automatically.

With “AI: complete and calculate” the anonymised text is sent to the ChatGPT AI configured on this site. “Local calculation” neither sends nor stores the text. In both cases the result requires professional review.

Indicative analysis

Legal classification and limitation period

Describe what happened and press “Analyse the account”.

Verification required. Aggravating circumstances, attempt, continuazione (several offences carried out under a single criminal design), succession of statutes, interrupting acts, suspensions and a first-instance judgment may change the result. Where the account does not allow a sufficiently sound classification, the calculator does not produce a false expiry date.

      How the estimate is built

The AI analysis breaks the account down and considers the relevant offences under the Italian Criminal Code and the principal special criminal statutes; the local fallback calculation compares recurring categories. The limitation period is governed by the general rules of artt. 157 e 158 c.p. For completed offences it uses the day of consummation; for attempted offences the cessation of the activity; for continuing (permanenti) or continuati offences the cessation of the permanence or of the continuation. Where there are several dates it prudently uses the last one and states this in the result.

General rules verified as at 13 August 2026.

      Frequently asked questions

Does the calculator determine conclusively which offence was committed?

No. It proposes one or more classifications compatible with the conduct described. The analysis establishes neither the facts nor liability. The final legal classification depends on the facts proved, on the charge and on the circumstances.

Why does a date sometimes not appear?

Where a complete date, or sufficient material to identify the offence, is missing, an expiry date would be misleading. The system therefore indicates the information to be added.

Is the day on which I discovered the facts always the day from which time runs?

No. As a rule what counts is the consummation of the offence. Discovery may not coincide with the day from which time runs; special rules also exist for attempt, permanence, continuazione and certain offences against minors.
